These Terms govern the use of the Motohub mobile application, website, APIs and related services (the “Service”). The Service is owned and administered by Bon Aleksei Michailovich (the “Operator”). Contact: support@motohub.app.
By installing the app, creating an Account, accepting these Terms, or continuing to use the Service after updated terms take effect, the User agrees to these Terms, the Privacy Policy, Community Guidelines, and Moderation and Enforcement Policy.
1. Definitions and nature of the Service
“User” means an individual using the Service. “Account” means a registered user account. “Content” includes profile information, avatars, photos, videos, text, comments, messages, reactions, routes, trip records and other materials submitted through the Service.
Motohub is an informational and social platform for motorcycle users. It is not a medical, emergency, insurance, dispatch, or guaranteed navigation service and does not replace professional advice.
2. Eligibility and age
The Service is intended only for persons who are at least 18 years old and legally able to enter into these Terms. The Operator may request reasonable age verification and suspend or remove an underage Account.
3. Account registration and security
Users must provide accurate information, keep it current, protect credentials, and must not sell, rent, transfer or share Accounts.
The User is responsible for activity through the Account until the Operator is notified of compromise. The Operator may require password resets, re-authentication or other safeguards.
4. Motohub features
The Service may provide trip and route recording; distance, speed, duration, elevation, lean-angle and weather statistics; optional heart-rate processing; feeds, profiles, friends, rankings, achievements, comments, reactions, direct or group chats, notifications and other functionality.
Availability and accuracy depend on devices, operating systems, permissions, GPS, sensors, connectivity and third-party services. Features may be modified, suspended or discontinued.
5. Road and riding safety
Users must obey traffic laws, monitor road conditions and never interact with a device in a manner that distracts from riding or driving.
Routes, alerts, weather and other information are informational only. Users independently assess road safety, speed, surface, weather, vehicle condition and personal fitness.
To the extent permitted by law, Motohub is not liable for collisions, injuries, fines, property damage or consequences of a User’s riding decisions.
6. Health information disclaimer
Heart-rate and fitness information is not medical diagnosis, treatment or advice. Motohub is not intended to detect disease or support emergency decisions. A User who feels unwell must stop and seek appropriate medical assistance.
7. User Content
Users retain ownership of their Content and are responsible for its legality, accuracy and consequences. Users represent that they have all rights and consents necessary to upload and share it, including consent from identifiable persons.
Users should not publish home addresses, precise vehicle storage locations, another person’s routes, or other information that may create a safety risk. Privacy settings cannot guarantee absolute confidentiality.
8. Content licence
By submitting Content, the User grants the Operator a non-exclusive, worldwide, royalty-free licence, including technical sublicensing to service providers, solely to host, reproduce, format, transmit, moderate, back up, display and promote the Service.
The licence ends when Content or the Account is deleted, subject to temporary retention in backups, logs, complaint files and evidence of violations. Copies redistributed by other Users may remain outside the Operator’s control. The Operator does not acquire a right to sell User Content as a standalone asset without separate consent.
9. Friends, feeds and visibility
Depending on settings and Service design, a nickname, avatar, motorcycle, achievements, ranking position, aggregated statistics and selected Content may be visible to other Users.
A friendship, follow, reaction or message does not verify a person’s identity or safety. Users decide independently whether to meet or disclose information.
10. Rankings and achievements
Rankings are generated by Operator-defined algorithms and are not official sports results, monetary obligations or guaranteed rewards.
The Operator may change formulas, periods and categories, recalculate results, and invalidate data affected by errors, GPS anomalies, manipulation, automation or violations.
11. Comments and chats
Messages and comments are the authors’ Content. The Operator does not endorse them and generally does not pre-screen every communication.
Threats, harassment, unwanted sexual communications, spam, scams, unlawful offers, disclosure of personal data without a lawful basis and circumvention of blocks are prohibited.
Users can block others and report Content. The Operator may access complaint-related messages and metadata as reasonably necessary for safety, investigation and legal compliance. The Service does not
guarantee indefinite storage or delivery of communications and must not be used as an emergency channel.
12. Prohibited conduct
Users must not violate laws or rights; impersonate others; harass or dox; manipulate rankings; spoof GPS or sensors; create fake-account networks; send spam; distribute malware; attack or bypass security; scrape data; reverse engineer except where law permits; use unauthorized bots, clients or APIs; or resell access.
The Service must not be used to organize unlawful or dangerous riding, conceal wrongdoing, or publish precise information that creates a theft or safety risk.
13. Motohub intellectual property
Software, design, databases, brands and other Service elements belong to the Operator or licensors. Users receive a limited, revocable, non-transferable right to use the Service for personal, non-commercial purposes. No other rights are granted.
14. Third-party services
The Service may use mapping, geocoding, weather, cloud hosting, Health Connect, Firebase Cloud Messaging, diagnostics and other third-party components governed by their own terms. The Operator does not control independent providers but manages data processing as described in the Privacy Policy.
15. Paid features
If subscriptions, purchases or Premium features are offered, pricing, duration, renewal, cancellation and refund information will be presented before purchase and may also be governed by the app store and mandatory consumer law. Deleting the app does not cancel a subscription.
16. Moderation and enforcement
The Operator may use automated and human systems to identify violations, review reports, restrict distribution, remove Content, disable features, mute, suspend or terminate Accounts.
Measures depend on severity, repetition, risk, legal requirements and history. Urgent action may be taken without prior notice. Appeals are governed by the Moderation and Enforcement Policy.
17. Termination and Account deletion
Users may stop using the Service and request Account deletion in-app or by email. Identity verification may be required. Data is deleted or anonymized under the Privacy Policy, except where retention is required for law, safety, disputes or protection of rights.
18. Disclaimer of warranties
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, the Operator does not warrant uninterrupted or error-free operation, GPS/sensor/map/weather accuracy, universal device compatibility, or preservation of every item of data. Mandatory consumer rights remain unaffected.
19. Limitation of liability
To the maximum extent permitted by law, the Operator is not liable for indirect losses, lost profits, loss of data, reputational harm, User conduct or independent third-party services. Nothing excludes liability that cannot legally be excluded.
20. Indemnity
To the extent permitted by law, the User will reimburse documented losses caused by the User’s unlawful Content, infringement of third-party rights, or material breach of these Terms.
21. Changes to the Service and Terms
The Operator may update the Service and these documents. Material changes will be notified in-app, on the website or by email where required. Users who disagree must stop using the Service and delete the Account.
22. Governing law and disputes
These Terms are governed by the laws of the Russian Federation, subject to mandatory protections of the User’s country of residence. Before litigation, a User should send a detailed claim to support@motohub.app. The normal response period is 30 calendar days unless law requires otherwise.
23. Miscellaneous
Invalidity of one provision does not affect the others. Failure to enforce is not a waiver. Rights and obligations may be transferred as part of a reorganization or transfer of the Service, subject to applicable law.
The Russian and English versions are intended to have the same meaning. For Users in Russia, the Russian version prevails in case of conflict unless mandatory law requires otherwise.
